Distracted driving is one of the leading causes of car accidents, both in Massachusetts and across the country. Much of this distraction is caused by improper cell phone use, whether it's a driver talking on the phone, texting, or even surfing the web from behind the wheel. According to the National Highway Traffic Safety Administration (NHTSA), there are three different types of distractions that can lead to accidents: manual (taking hands off the wheel); visual (taking eyes off the road); and cognitive (taking mind off driving). All three of these may result from cell phone use while driving. For example, the NHTSA estimates that texting while driving makes a motorist two times more likely to get into an accident on the road.

But cell phone use isn't the only risky behavior that can lead to crashes. Driver distractions also come from:

  • Eating and drinking
  • Changing CDs or radio stations
  • Talking to passengers
  • Grooming
  • Reading maps or using a GPS
  • Watching TV or other video

Distracted driving encompasses any behavior that diverts a driver's attention from the primary task at hand: getting from point A to point B safely.

Massachusetts Lawsuits for Distracted Driving Crashes

A person who is injured in a car crash caused by another's distracted driving has the right to seek a variety of remedies from the responsible parties. These remedies are intended to make the injured person whole after an accident, and often include money for medical bills, lost wages, property damage, and pain and suffering.

Negligence is the most common legal theory under which a person injured in a car accident may seek legal redress. In order to prove a negligence claim, the injured person (plaintiff) must show that the person being sued (defendant) owed a duty of care to the plaintiff to exercise reasonable care, that the defendant breached this duty of care, and that the breach caused the plaintiff's injury. Drivers, for instance, generally have a duty to operate their vehicles in a reasonable and safe manner. Those who cause an accident by failing to do so can potentially be held liable for negligence.
