The size of the award will be reduced to an amount proportionate to the extent of the defendant’s responsibility for the accident. For instance, an injured person who was 35 percent at fault can get compensation for 65 percent of the damages that he or she suffered. It is critical to remember, however, that a negligence claim must be filed within a certain time after the accident giving rise to it. Victims who fail to file within this period probably cannot receive compensation.
