Filing a Negligence Claim to Recover Damages

Spinal cord injury lawsuits often proceed on the basis of negligence. This means that the victim can get compensation from a defendant even if the victim was partly at fault for the accident, unless the victim was more than 50 percent responsible for it. The size of the award will be reduced to an amount proportionate to the extent of the defendant’s responsibility for the accident. For instance, an injured person who was 35 percent at fault can get compensation for 65 percent of the damages that he or she suffered. It is critical to remember, however, that a negligence claim must be filed within a certain time after the accident giving rise to it. Victims who fail to file within this period probably cannot receive compensation.
