Even in cases in which a victim is partially to blame for the accident, he or she still may be able to recover some damages under Massachusetts’ modified comparative negligence rule.

In most ordinary situations, an injured person can assert the right to compensation by pursuing a negligence claim. This is a legal theory that holds people and entities accountable for breaching what the law calls a “duty of care.” Drivers, for example, owe others on the road a duty to operate their vehicles in a reasonably safe manner. Someone who fails to live up to this standard and causes an accident as a result is likely to be liable for negligence. A similar standard applies to property owners, which are expected to maintain their premises in a reasonably safe condition so that visitors to the area are not subjected to an unreasonable risk of harm.

Often, however, it is the defendant’s insurance company with whom you may wind up battling. Massachusetts law requires insurers to act with “candor and fairness” when they review and handle claims. This is usually considered a “good-faith” standard that obligates an insurer to make adequate attempts to settle claims when possible in order to avoid needless and protracted litigation.
