Injury Attorneys Advocating for Wellfleet Residents

Our dedicated injury lawyers assist people in Wellfleet and the surrounding communities after they have been harmed by the careless actions of another person or entity. At the Law Offices of John C. Manoog, III, we have more than 146 years of combined experience representing individuals and families in a wide range of accident cases. We understand how difficult it can be to cope with the aftermath of a car crash or another mishap, especially if it is caused by no fault of your own. Our attorneys pride themselves in taking the time to fully understand each person’s particular situation and in fighting aggressively to seek the full legal remedies to which they may be entitled.

Pursuing Compensation through a Negligence Claim

If you have been involved in a motor vehicle collision, a slip and fall, an incident of medical malpractice, or another harmful event, you likely have the right to bring a claim for damages against any party that was responsible. Compensatory damages are intended to make a person whole after an accident, or bring the victim as close as possible to his or her position before being injured. These damages often include money for doctors’ bills, property damage, missed wages, and pain and suffering, among other items. Even in cases in which a victim is partially to blame for the accident, he or she still may be able to recover some damages under Massachusetts’ modified comparative negligence rule.

In most ordinary situations, an injured person can assert the right to compensation by pursuing a negligence claim. This is a legal theory that holds people and entities accountable for breaching what the law calls a “duty of care.” Drivers, for example, owe others on the road a duty to operate their vehicles in a reasonably safe manner. Someone who fails to live up to this standard and causes an accident as a result is likely to be liable for negligence. A similar standard applies to property owners, which are expected to maintain their premises in a reasonably safe condition so that visitors to the area are not subjected to an unreasonable risk of harm.

If you are hurt in an accident, you might assume that any case that you have is against the person or other party that was directly responsible for harming you. Often, however, it is the defendant’s insurance company with whom you may wind up battling. Massachusetts law requires insurers to act with “candor and fairness” when they review and handle claims. This is usually considered a “good-faith” standard that obligates an insurer to make adequate attempts to settle claims when possible in order to avoid needless and protracted litigation.
