In Massachusetts, most personal injury cases revolve around claims for negligence. In order to prove negligence, the accident victim (plaintiff) has to show that the person or entity being sued (defendant) breached what the courts call a “duty of care.” A property owner, for example, owes visitors a duty to maintain the premises in a reasonably safe condition and to warn them of any hazards, such as wet floors, icy sidewalks, or rickety railings, of which the owner knows or should be aware. A doctor owes patients a duty to provide a certain level of skill in treatment and diagnoses that is based on training and experience as well as the area where the doctor practices.

In a car accident case, by contrast, a driver owes others on the road a duty to operate his or her car with reasonable care and to refrain from speeding and other types of dangerous behavior behind the wheel. The driver’s actions will be compared to what an ordinary driver would have been expected to do under the circumstances. Would a reasonable person have noticed that traffic was slowing quickly and stepped on the brakes in time to avoid a crash? Would a reasonable person have given a cyclist more room on the shoulder of the road? These are the types of questions that a judge or jury often must consider in accident cases.

To prove negligence, the plaintiff also has to show that the defendant’s breach of care directly caused the accident and resulted in the victim suffering certain damages. This often requires significant medical evidence detailing the cause of the injury and its impact on the plaintiff, as well as proof of precisely how the accident happened in the first place.

A plaintiff who establishes negligence may be entitled to damages to cover medical bills, lost wages, property damage, pain and suffering, and emotional distress. In certain cases, additional punitive damages may be available as a way to punish a defendant for particularly callous behavior. In situations where the defendant was acting in the course of his or her job at the time of an accident, the plaintiff may also be able to seek damages from the defendant’s employer under a vicarious liability theory.
