Massachusetts fatal accident: Head-on dirt bike crash kills teen

A wrongful death civil claim is not limited to fatal car accidents. In Massachusetts, this type of legal proceeding is appropriate whenever someone negligently or intentionally causes or contributes to the death of another individual. A fatal accident involving two dirt bikes has resulted in criminal charges in Plymouth.

The tragedy occurred last December. A man from Randolph, said to be 40 years old, was operating a dirt bike when he collided head on with a dirt bike operated by a 14-year-old local boy. The teenager, a student at Plymouth North High School, lost his life in the crash. Moreover, the older man apparently left the boy to fend for himself.

DUI failure to yield blamed in Massachusetts teen car accident

Teenage drivers and alcohol is often a recipe for disaster. Yet another serious DUI related car accident occurred recently in Worcester. Of the four females in one car, one was hurt critically and another seriously. The 17-year-old Massachusetts driver was not seriously hurt, and a front seat passenger escaped injury. The driver of the other vehicle, a 19-year-old male, also escaped injury.

The accident occurred close to midnight in mid-April. Preliminary evidence, including witness statements, suggests the car with four occupants tried to cross Route 20 to enter the parking lot of a McDonald's Restaurant. As the driver crossed the highway, she moved directly into the path of an eastbound SUV operated by the male teen.

Massachusetts wrongful death: FDA takes on energy drink makers

A wrongful death civil lawsuit in Massachusetts is not limited to fatal motor vehicle accidents. Rather, our laws deem a wrongful death to have occurred whenever someone loses their life as a consequence of the negligence of another. If the negligence is deemed to have caused or substantially contributed to the death complained of, liability may attach in a civil legal proceeding. One area of potential personal injury and wrongful death litigation involves the manufacturing and sale of so-called energy drinks.

A significant number of personal injuries and some fatalities suffered by those ingesting these drinks have caused regulators to focus on the ingredients that comprise these popular items. Amid reports that consumers are spending more than $12 billion annually to purchase these items, the FDA has identified the dietary supplement dimethylamylamine as a potential culprit. The federal Food and Drug Administration has stepped up efforts to educate consumers to the potential dangers, as well as to go after drink makers that use the illegal supplement, otherwise known as DMAA. The supplement has not been approved for use as an additive in energy drinks in the absence of proof that it is safe for consumers.

Massachusetts worker suffers devastating fatal workplace injury

A 24-year-old worker for a Massachusetts subcontractor was killed while working for the company on an out-of-state project. The tragedy unfolded on a Saturday morning in mid-April. The victim was crushed under the weight of a lead pipe in the fatal workplace injury.

The incident took place at a construction project. Workers were in the process of unloading a 40 foot section of piping that apparently weighed some 1,700 pounds. Though it is not exactly clear why, the pipe fell a distance of about 8 feet from an excavator. It landed on top of the man, who lived in Dorchester.

Police say Cape Cod drunk driving car accident injures local man

Despite the efforts of law enforcement personnel, drunk driving continues to be a problem on Cape Cod and throughout Massachusetts. A recent car accident in Wellfleet resulted in injuries for one driver and criminal charges for the other. The collision occurred shortly after 9:15 p.m., where Route 6 intersects with Main Street.

Both drivers are reportedly residents of Cape Cod. A 48-year-old man apparently exited Route 6 onto Main Street in an SUV, crashing into a car in the process. The car driver was transported to the hospital. Though the specific nature and extent of his injuries was not described, he was later released from Cape Cod Hospital. There were no reports of others involved in the crash or of any injuries to the SUV driver.

Boy, 14, suffers severe dog bite injures by guard dogs

Unfortunately, there has been another vicious dog bite attack in Massachusetts. The latest incident occurred at a construction demolition yard in Revere. A 14-year-old boy suffered severe dog bite injuries, and when a hero cop showed up to help, the boy was unresponsive. Rushed to the hospital, the boy suffered open wounds to his skull, has undergone surgery, and is facing multiple plastic surgery operations down the road.

The report of the attack is terrifying. A 12-year-old friend of the victim called 9-1-1 while the two Rottweilers, both guard dogs, were mauling the victim. The two boys had been visiting the dogs for months and petting them through the fence without incident. On the day of the attack, the older boy climbed over the fence, and the animals set upon him after he fiddled with his cell phone.

Fatal accident claims life of Massachusetts teen; DUI blamed

A recent car accident involving two Massachusetts women from Middleboro resulted in the death of one and criminal charges for the other. The accused driver has been charged with homicide by a motor vehicle, along with a number of unspecified additional charges. The fatal accident took the life of an 18-year-old girl that was described by one friend as an angel on earth. It also resulted in injuries to a passenger in the pickup truck of the woman now facing criminal charges.

The fatal accident occurred in the early morning hours of the last Saturday in March. Details of the crash were few, though authorities asserted the accused woman was both drunk and under the influence of heroin. Her blood alcohol content was reportedly .14 percent, well over the Massachusetts limit of .08 percent. Both vehicles apparently overturned.

Massachusetts dog bite attack: 400 stitches, dog put down

The mother of a 6-year-old Massachusetts boy that was attacked by a nearly 50 lb. dog recently filed a complaint with the Mansfield Selectmen. She asked the governmental body to declare the animal dangerous and to order that it be put to sleep. Her son was mauled in the dog bite attack, and he required more than 400 stitches to close a multitude of wounds to his face and body.

After the terrifying incident, the neighbors were required to keep the dog inside their home while the selectmen acted on the mother's complaint. The local animal control officer testified during formal proceedings that the animal would likely bite another time and that such an attack could be even more severe. The selectmen ultimately determined the animal was dangerous and ordered it to be euthanized. The owners were given 10 days to appeal the ruling.

Massachusetts workers' compensation: PT domestic workers next?

There is a move under foot in several states, including in Massachusetts, to extend labor protections to all domestic workers. Under current laws, some of these workers are typically denied such rights as overtime pay and breaks to eat. Many are also denied the right to workers' compensation insurance benefits. Currently, under Chapter 152 of the Massachusetts General Laws, a domestic worker employed for less than 16 hours weekly is only covered by workers' compensation if the employer voluntarily chooses to include them. The same is true of seasonal or casual workers.

On the west coast, a state assemblyman intends to reintroduce a bill addressing these issues. It was ultimately defeated last year. At that time, their state governor exercised a veto amid concerns that passage of the law would adversely impact the elderly and infirm, particularly those who require 24-hour care.

Fatal accident on Cape Cod: Did pickup driver fall asleep?

A deadly Cape Cod motor vehicle accident in mid February resulted in criminal charges for a driver who apparently fell asleep at the wheel of his pickup truck. The fatal accident occurred in Bourne in the late afternoon. No explanation was offered by authorities as to why the 20-year-old truck driver dozed off at that hour.

The pickup driver is a resident of Cape Cod. Authorities indicate he lost control of his vehicle while traveling on Sandwich Road, swerving into the oncoming lane of travel. Tragically, two women in their early 80s were occupying a car that was struck head-on by the pickup.
